TERMS AND CONDITIONS

1. All payments to AZDToons.com will be made via PayPal, Epassporte, Xoom, Wire Transfer, and Western Union- other payment options subject to requests and approval.

2. AZDToons.com shall require 50% downpayment of the project/s total amount before the start of any design project/s. All backup files used in the design including psd photoshop files will be sent to the client upon the completion of the project and as soon as the 50% balance is settled.

3. AZDToons.com does not affiliate nor associate with any site containing chils porn, websites containing obscene material, including without limitation any material depicting bestiality, rape or torture.

4. No traffic from sites that contain material which constitutes an infringement, misappropriation or violation of any person’s intellectual property rights such as copyrights, trademark rights, rights of publicity, patent rights, personal property rights, privacy rights or other rights.

5. You must be over the age of eighteen (18) years, or over the age of majority if you reside and/or conduct business in states, provinces or countries where the age of majority is greater than eighteen (18) years. You may not participate in any way if you are not of the age of majority in the state, province or country where you reside and/or conduct business

6. Modification. We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion. Notice of any change by e-mail, to your address on our records, or the posting on our site of a change notice of a new agreement, is considered sufficient notice for notifying you of a modification to the terms and conditions of this Agreement.

7. Indemnification. You hereby agree to indemnify, defend and hold harmless AZDToons.com (AZDToons.com), its officers, employees, agents, affiliates, successors and assigns, from and against any and all claims, losses, liabilities, damages or expense (including attorneys' fees and costs) of any nature whatsoever incurred or suffered by us (collectively the "losses"), insofar as such losses (or actions in respect thereof) arise out of or are based on (a) any claim or threatened claim that our use of your trademark(s) infringes on the rights of any third party; (b) the breach of any promise, covenant, representation or warranty made by you herein; or (c) or any claim related to your site.

8. You must be the one who owns or is otherwise is entitled to contract on behalf of the entity which owns the rights to your content/website.

9. You must be a person over the age of eighteen (18) years, or over the age of twenty one (21) in those states where 21 is the age of majority.

10. The client hereby releases AZDToons.com from any and all legal actions or monetary settlements arising from the purchaser providing us with unlicensed images or content to be used for the development of their design. Including the model(s) appearing in ANY images that the client provides for use in the construction of their design must be of 18 years of age or older.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND AZDToons.com (AZDToons.com). BY SIGNING UP YOU ARE AFFIRMATIVELY STATING THAT YOU HAVE READ AND UNDERSTAND THE TERMS SET FORTH HEREIN AND ARE AFFIRMATIVELY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND YOU AGREE TO BE BOUND BY THE TERMS THEREOF.
